TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use and Privacy Policy (collectively, the “Agreement”) govern your visit to and use of the [website address] site (the “Site”). YOUR ACCESS TO OR USE OF THIS SITE SIGNIFIES YOUR ACCEPTANCE OF THESE TERMS.

The International Seafood Sustainability Trade Association (“ISSTA” or “we” or “us”) reserves the right to change any provision of this Agreement at any time without notice. We will endeavor to post the date of the most recent revision at the top of this Agreement. You understand the need to revisit this Agreement from time to time to ascertain whether changes have been made. All such modifications shall take effect immediately upon posting on the Site. Your continued access or use of the Site after the modifications have become effective shall be deemed your conclusive acceptance of the modified Agreement.

ISSTA makes no representations about the suitability or accuracy of content available on or through this site (including any content provided through ISSTA RSS feeds to which you have subscribed) for any purpose. ALL CONTENT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND AND MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS.

Without limiting the foregoing, ISSTA and its respective suppliers hereby specifically disclaim all warranties and conditions with regard to such content, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the content will be free of interruption, or that the site is free of viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.

The contents of the Site belong or are licensed to ISSTA or our suppliers. We hereby grant you the right to view and use our Site subject to this Agreement. You may download or print a copy of content provided on or through the Site (including the ISSTA RSS feeds) for your personal, internal and non-commercial use only. Permission to reprint or electronically to reproduce any document, photograph or graphic from the Site in whole or in part for any other purpose is expressly prohibited without our prior written consent.

No Unlawful or Prohibited Use
As a condition of your use of this Site, you warrant to ISSTA that you will not use this Site for any purpose that is unlawful or prohibited by this Agreement. A violation or threatened violation of this provision may result in legal action against you.

GOVERNING LAW AND FORUM; MISCELLANEOUS PROVISIONS

This Agreement is between you and ISSTA and is governed by the laws of the State of Virginia USA. You hereby consent to the exclusive jurisdiction and venue of courts in Fairfax County USA in all disputes arising out of or relating to the use of this Site. Use of this Site is unauthorized in any jurisdiction that does not give effect to all provisions of this Agreement, including without limitation this paragraph. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement shall continue in effect. This Agreement constitutes the entire agreement between you and ISSTA with respect to the subject matter, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and ISSTA with respect to this Site. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
